DISCLAIMER AND LIABILITY WAIVER

SMP INTERNATIONAL, LLC
Cooking and Grilling Classes & Workshops

By signing this Disclaimer and Liability Waiver, you acknowledge and agree to the following terms and conditions for participation in cooking and grilling classes and workshops offered by SMP INTERNATIONAL, LLC (“SMP”):

1. Assumption of Risk
   I understand and acknowledge that participating in cooking and grilling activities involves certain inherent risks, including but not limited to exposure to high heat, open flames, sharp utensils, hot surfaces, burns, cuts, smoke inhalation, allergic reactions, or foodborne illnesses. I voluntarily assume all risks associated with my participation.

2. Health and Safety
   I confirm that I am in good physical condition to safely participate in the cooking and grilling activities considering the risks involved. I understand it is my responsibility to notify SMP of any food allergies, dietary restrictions, or health conditions prior to the event. However, I acknowledge that SMP cannot guarantee an allergen-free environment.

3. Release of Liability
   To the fullest extent permitted by law, I release, waive, and discharge SMP INTERNATIONAL, LLC, its officers, employees, instructors, agents and affiliates from any and all claims, liabilities, demands, actions, or causes of action for any injuries, damages, or losses (including property damage) arising out of or related to my participation in SMP classes or workshops.

4. Indemnification
   I agree to indemnify, defend, and hold harmless SMP INTERNATIONAL, LLC and its affiliates from any claims, damages, or costs (including attorney’s fees) resulting from my actions or conduct during the classes or workshops.

5. Participation Rules
   I agree to follow all safety instructions provided by SMP instructors and staff, including, but not limited to, the proper use of equipment and ingredients. Failure to adhere to these instructions may result in my removal from the class or workshop.

6. Alcohol Consumption                                                                                              Should I consume alcohol during the SMP classes or workshops, I acknowledge, agree and express that I am solely for any and all damages suffered to myself or that I may cause to third parties of the premises or property of SMP as a result of such alcohol consumption, including but not limited to, property damage, personal injury, death or loss of consortium. 

I acknowledge that it is against the law to serve, provide, or make available alcohol to anyone under the age of 21. I affirm not to provide anyone under the age of 21 with alcohol. I further acknowledge that should anyone under the age of 21 consume alcohol on SMP premises during SMP classes and workshops, I am solely responsible for the safety and well-being of that individual. 

I agree that SMP, its directors, operators, employees, agents, and volunteers are not responsible or liable for any damages to myself or third parties that result from the consumption of alcohol by myself or others, to include, but not limited to, property damage, personal injury, death, disfigurement, or loss of consortium.

7. Photography and Media Release
   I grant permission and approval for SMP INTERNATIONAL, LLC to photograph, film, or record me during classes or workshops. I understand and agree that these materials may be used for promotional or marketing purposes by SMP without compensation or further approval.

8. Age Requirement
   I confirm that I meet the minimum age requirement to participate, or I am accompanied by a parent/guardian who has also signed this waiver on my behalf.

9. Governing Law
   This Disclaimer and Waiver shall be governed by the laws of the State of Texas. Any disputes arising from this agreement shall be resolved in the courts of Bexar County, Texas.

10. I have read this Disclaimer and Liability Waiver in its entirety and agree with its terms. I have executed this Disclaimer and Liability Waiver voluntarily and without any inducement.
